Terms of Service

Welcome to Underground Design. These Terms of Service (“Terms”) govern your access to and use of the services provided by Underground Design (“Company,” “we,” or “us”). By purchasing any of our services, you agree to the following terms and conditions:
1. Services and Payment
All services offered by Underground Design must be paid for in full upfront through our website. Services are listed as products on Shopify, and customers can add them to their cart and check out as they would with a physical product. After the purchase, we will schedule a kickoff call to go over timelines, expectations, and the revision process.
2. revisions
Each project includes one revision. Any additional revisions beyond this are subject to additional fees, which vary depending on the scope and complexity of the service. Large projects may require more expensive revisions.
3. Cancellations
If a client cancels the project midway, no refunds will be issued. However, the client will receive any assets or work completed up to the point of cancellation. Alternatively, the client may request that we finish the project despite the cancellation.
4. Delivery Timelines
Projects have varying timelines based on the service purchased:
• Smaller projects (e.g., 5 static ads): Typically a 1-week turnaround.
• Larger projects (e.g., 4-page websites): Typically a 4-week turnaround.
If delays occur due to client inaction (e.g., failure to provide necessary assets), Underground Design is not responsible for any consequences, and no compensation will be provided. If we delay by more than one week without notifying the client at least 3 days in advance, the client is entitled to a 50% refund while still receiving the final deliverables. If we notify the client of a delay in advance, the client is entitled to a 25% discount on future purchases.
5. Client Responsibilities
Some services require the client to provide assets or content (“bring your own content”). This will be specified in the service description on the product detail page. Failure to provide these materials may result in delays, which will be the client’s responsibility.
6. Intellectual Property
Upon completion of a project, clients will receive the final deliverables and full ownership of the work. However, Underground Design reserves the right to use the work in future marketing materials, portfolios, and on our website.
7. Dispute Resolution
Our revision process serves as the primary method for resolving any disputes. Underground Design delivers work based on the creative brief filled out by the client. If the brief is unclear or incomplete, resulting in dissatisfaction, the responsibility lies with the client. We do not offer additional revisions or refunds beyond what is outlined above.
8. Liability
Underground Design is not liable for any damages, lost profits, or negative impacts resulting from our services. We deliver based on the client’s brief and review process. If the brief is poorly completed and results in unintended consequences, Underground Design bears no responsibility for the outcome.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.
